[EAS] Proposed "error" reporting

Notice in the rule (47 CFR 11.45) there is no definition of what a false EAS alert message is:
 
"b) No later than twenty-four (24) hours of an EAS Participant's discovery (i.e., actual knowledge) that it
has transmitted or otherwise sent a false alert to the public, the EAS Participant send an email to the
Commission at the FCC Ops Center at FCCOPS at fcc.gov, informing the Commission of the event and of
any details that the EAS Participant may have concerning the event."
 
Although, using typical rules of statutory interpretation, one could refer back to paragraph (a):
 
"(a) No person may transmit or cause to transmit the EAS codes or Attention Signal, or a recording or
simulation thereof, in any circumstance other than in an actual National, State or Local Area emergency
or authorized test of the EAS; or as specified in §§ 10.520(d), 11.46, and 11.61 of this chapter."
 
Sec. 11.46 is the new section on using simulated tones in EAS PSA's. Sec. 11.61 is the new section providing for "live code" tests. Section 10.520 talks about the wireless alert tones.
 
Now (a) prohibits the transmission of EAS codes or attention signal in any circumstance other than an actual National, State or Local Area emergency. We have a box sitting in a rack. Unattended and untouched by human hands.  If it receives a message preceded by the proper EAS codes --and it has been set up to relay a message so encoded--it will interrupt programming and "transmit" these codes, as well as any message that follows.  Therefore, if the codes are correct (and if they are not, the box should ignore them) --can the alert therefore be "false?"
 
What duty does the broadcaster have at that point to further investigate the veracity of the message following the EAS codes?
