My response would be "Read your state EAS plan and follow the plan."

That is, of course, requires that your state has updated the plan to 
include CAP.

If the plan does not include CAP then you can be in trouble for not 
"following the plan".

Classic Catch-22.

After all, "We're from the government and we're here to help you."
