 Yep. Non-D AM above, I think, you're 10 is right.

 What requirement ?

 There's a rule that the CO is responsible for technical compliance, but
 none that he/she must be technically competent him/herself.
 The CO can supervise engineers to achieve technical compliance as
 easily as do it himself, under the rules.

 Additionally, nearly all of the CO duties can be delegated to someone
 else, as long as the CO has supervisory oversight.

 It's merely a supervisory position, not an engineering position.
 ( which is WHY the CO must be an employee )

 I happen to be "the" guy for whom that clarification was issued.
 Odd way to be offered a job, but it was an OK job for 12 years or so.
