Different rules.  

Amateur radio rules are covered under 47 CRF Part 97 (and 97.111 specifically defines authorized uses, IIRC).  

Cell phones are a Common Carrier Service - and while they use RF spectrum - the rules governing those services are quite different (47 CFR Part 20).  Criminal and unauthorized activities over common carrier networks are covered under both federal and state laws.

Because cell phones use RF spectrum, wouldn't the FCC have just as much jurisdiction over cell phones, used in the commission of a felony, as they do with CB, FRS, GMRS, amateur, etc.?
