After having read a few of the responses, it seems that I haven't made clear the intent of the questions I originally posed.
I seek the following:
Some ruling related to, if one is required to notify the FCC about issues in receiving NWS when it is a mandated monitoring source in a state plan.
The gray area that I am trying to clarify relates to the FCC not requiring stations to monitor NWS unless it is one of the two required sources for a national alert. And if it is NOT one of those two sources being monitored, is that monitoring optional under federal law? And if optional is there any requirement to report the non-reception of NWS to the FCC.
I fully understand, and am quite aware of the regulations that discuss monitoring in a state plan. I also understand that with EAS equipment failures, one must notify the FCC if the problem goes beyond 60 days. But does this requirement include NWS?
I'd love to debate these opinions, and can do that all day. But right now I am only interested in verifiable facts that someone can cite from regulation or written legal precedence.
