Yes! I had forgotten about the simulated tones.

To me, having done that only adds to the confusion of when you can and when you can't. It is in high contradiction to the FCC mandate of thou shall not, under any circumstances air, or allow to be aired simulations of EAS tones (paraphrasing). And realistically, with the hatred most station manager's feel towards EAS tones aired for real alerts and tests, why would they go out of their way to air them in a PSA? Either the commish didn't think this through, or it was a stroke of reverse psychology genius on their part.

And you know there will be that person who comes up with a way to try and get around it with some clever use of a loophole they interpret in the rules. I can think of one right off the top of my head without trying very hard. Not that they wouldn't still get cited, but the cat's already out of the bag, and the very thing the FCC is trying to prevent happened anyway.
