For one thing the need for repeating an EAN in the Bill does not seem to be well thought out. Did whomever write this bill not know that EAN captures EAS boxes until released and EAS boxes do not have unlimited store and forward?...

Everything you said Richard, is almost exactly what I told our management in an email (rant) to them yesterday.
This is just another instance of "feel good" legislation designed to make it look as if they are fixing a problem. In reality, no one involved in this bill, right down to the high school student working for the congressman, who's job it is to run the Xerox machine understands the problem. (Not that I would expect the Xerox kid to understand, but neither does anyone above them.)

This is nothing more than a knee jerk reaction to a mistake made in Hawaii that was compounded by not being able to properly respond to and recover from that mistake. If congress wants to fix public warning, they are going to have to put serious money into support for training and drills that lead to a level of proficiency so as to reduce these errors to an acceptable level.  And to train in how to properly recover from errors if they happen. You'll never eliminate the mistakes totally, but if they can at least be reduced in numbers and severity such that congress doesn't feel the need to fix them, then that goes a long way.

Each warning mistake that results in subsequent, knee-jerk legislative action only serves to indicate that the lawmakers haven't done their due diligence in the first place.
