The reasons the FCC has not acted are
 
1-      Because so many people, out the goodness of their heart, have been telling the FCC that the relay technology used for EBS is perfect and does not need to be changed.
 
2-      The great fear that asking the FCC to act will result in someone having to purchase something (Horrors) 
 
3-      There has not been a major communications failure that exposed these short comings to the degree that any 'political heat' is developed that would 'light a fire' in the appropriate places.
 
4-      Too many that make policy have little experience in the real-world.
