Someone will file a petition for reconsideration if it's an administrative
rule. When the FCC declines the petition, it too can head for the DC
circuit where the well informed judges on this panel can reach the same
conclusion:  An unreasonable burden on broadcasters.

If it should come as a statute, well...that's a different animal with a
much higher burden to over come to obtain a stay. Much the same as the
current burden needed to get that statute passed in the first place.
