It is mandatory for RMT - 11.61(1) Required Monthly Tests of the EAS 
header codes, Attention Signal, Test Script and EOM code.

It *might* be required for any other alert that also contains an 
audio message - it all depends on how you interpret "and".

11.51(b) (b) When relaying EAS messages, EAS Participants may 
transmit only the EAS header codes and the EOM code without the 
Attention Signal and emergency message for State and local 
emergencies.  [...] No Attention Signal is required for EAS messages 
that do not contain audio programming, such as a Required Weekly Test.

Does this mean that for state and local emergencies, you can send 
just header+eom only if you drop attention AND audio message?  Does 
the 2nd part above imply that the attention signal IS required for 
messages that DO contain audio programming? The intent would be far 
clearer if Part 11 simply said that the attention signal was optional 
for state and local emergencies.

The largest recent addition to the record was in the Third FNPRM 
(2011) and submitted comments, which the FCC addressed in the Fifth 
R&O (2012).  The commission decided to keep the signal and keep it at 
eight seconds long, citing all the reasons why the signal was worth 
keeping, and
