David,

I think your questions #2 and 3 are best answered by learned counsel and
your state's AG after consulting with state EMA officials and the FCC.

My take is the NPT is a NATIONAL test. That's what the name implies. If it
were my call as a SECC, I would not propose use of the NPT at the state
level without specific directive from the FCC or FEMA.

RMT's are for the state/local agencies to test their systems and the FCC
provided the mechanism to do that once a month (or as needed as
circumstances require).

NPT is the fed's vehicle to achieve the same result, though at some
greater interval....FWIW....
