That depends on your definition of non-participating.
By non-participating, do you mean they chose to not participate in EAS because they are cable networks or some other entity where part 11 rules don't apply?
OR
Non-participating under part 11 EAS rules.

My understanding is, if you are required to receive and send EAS alerts under part 11, then you ARE participating (your non-part' status was automatically revoked with rule changes)??
If you used to have a EAS designation of non-participating, but were required to encode and decode EAS then you are now participating??

Non-parts' under FCC-11 are only those stations who are not required to encode??

Does that sound right????
