NOT TRUE.  I have $10,000+/mo.  studio and TX electric bills to prove 
that electricity is taxed...and quite so I might add.  I also have many 
invoices on test gear bought over the years stating the same.

Anything tangible (or a commodity tangibly assigned a value for 
commerce) is taxable at the point of sale.  The loophole is inter-state 
sales where the product is shipped to the buyer by common carrier.  That 
loophole is being forcefully dealt with by some states (including 
Illinois).  Many out of state vendors are now charging me Illinois sales 
tax so they don't get sued by Illinois.

And don't forget, most states and many cities have a Use-Tax one is 
supposed to pay on out-of state purchases. Chicago ties the Use-Tax to 
issuing business licenses.  Businesses must sign an affidavit they have 
paid their obligated use tax on out-of state purchases.  The affidavit 
gives the City power of audit to come in and review a business's 
records.  Very draconian.  But it's worth millions in added revenue.

Like EAS, this is something which needs to be dealt with at the federal 
level to establish minimum standards.  Which if it involves a minimum 
tax is counter to states which don't have a sales tax (such as News 
Hampshire).  Messy....
