There is no ATTN on/off bit in CAP.

 From part 11.51(a), "The Attention Signal must precede any emergency 
audio message"

and (b) "No Attention Signal is required for EAS messages that do not
    contain audio programming, such as a Required Weekly Test."

So, if a CAP-derived alert aired that did not contain audio 
programming, then the ATTN tone would not be required, though would 
still be permitted.

In context, "audio programming" means something other than the header and EOM.
