No Dave there is nothing that would prevent a state from wanting to 
do that....However, I believe that the state cannot require a broadcaster
to do something that is contrary to FCC rules.  

You hit upon a very sensitive subject for me....I have long felt that 
one of the major problems with the EAS is that broadcasters can,  
and many have, elected to not air important EAS messages.   This 
has hurt EAS significantly.   If you were an emergency manager, 
you have come to learn that the EAS is something that, perhaps, 
you can not count on to get your message out.   This is the basis
of the whole GMC thing.

Hopefully this will all get sorted out to the benefit of all.
