None of that appears in the rules applicable to FM broadcast stations,
part 73 subpart B or at least not that I can find.
73.310(a)(2) in the sixteenth paragraph does rather specifically define
100% modulation, but not how it is to be measured.
73.1570(b)(2) ( which contains a typo as compared to years past ) is the
section spelling out "peaks of frequent reoccurance" ( currently )
and so would seem to be the "ambiguity" in the rules one makes the
mountain out of.
Again, no requirement as to how it is to be measured.
Methinks it is assumed that one skilled in the art should be competent
enough to devise an accurate methodology.
I'm not saying it isn't in there somewhere. Just that I didn't find it this morning.
I did note that in the NOI regarding modulation monitors that the Commission
noted that cases at the margins didn't seem to exist, either prior or since,
but that violators tended to be blatantly obvious, so all that Eric Small
achieved was confusion on something that was previously quite clearly
understood, to sell his own product.
