In this case, the IX was proven and repeatedly so. And moreover admitted
to by Apple as being a problem. They were on notice and didn't remedy the
problem as ordered. It doesn't matter whether it was a competing station. 
They didn't follow the explicit and legal order of the FCC.

I had a former client experience a shut down order once. After I left
them, they got a visit. In all reality, they didn't have a license to
operate ND full class power, the CP called for a DA at something less than
full power,  and the as-installed antenna was not the specified DA. The
field engineer simply asked "By what authority do you have to operate at
these parameters?"  They didn't and off they went.
