 Almost.
 It's 8% up to and including 5KW.
 Above 5KW it's 5.3%.

 However, the relevant rule is 73.1560 and for all classes there is wording
 such "must be maintained as near as is
   practicable to the authorized antenna input power and may not be less
   than 90% nor more than 105% of the authorized power."

 The operative words, and where it becomes a violation, are "maintained
 as near as is  practicable to the authorized antenna input power"
