A directional AM station over 1 kilowatt can run 5% over power to make up for
Phasor losses. 1 kW and less can run 8% over power for the same reason. I
always run 1080 watts here at WURD.

Is it legal to always run five percent higher power than the
station is licensed for?

Heard an engineer of a fifty kw station say he always runs
his station at 52,500 watts.
