It's the same today. Nothing has changed. The FCC is a toothless paper
tiger for the most part. The Marshall's are needed to enforce the
confiscation orders or warrants to enter and search.
This is where the states can really come in to the mix. As with
Florida, they can nail the !@#$%^&* and property owners using zoning and
business ordinances and statutes. The suckers who transmit from their
homes or religious buildings end up in a bigger mess as the locals can
then go after them for operating a business out of their house or
non-profit without a business license or proper zoning The idiots end up
in courtroom after courtroom pleading their way through the red tape.
IIRC, that was done to a Miami area idiot who allowed a station to
transmit from his office building and claiming to not know what was
going on with that funny thing on the roof.
While it's an unfunded enforcement process foisted upon for the locals,
I suspect law enforcement has some input on who to bust based on gang
and/or drug activity.
