Not sure about legal - if the commercial producer obtained permission 
from the copyright holder, it'd be legal, I'd bet.

However, practical is another issue.  For example, United Airlines used 
Gershwin's "Rhapsody In Blue" behind the entire spot - all :60 seconds 
of the spot, although "RiB" runs just over 16:00.....

And you'd still need to get permission from the copyright holder before 
such an extended use.  Or even a short clip, probably.  There's a bank 
that uses clips from he Sinatra recording of "I've Got The World On A 
String", but just that line; they fade the next line under, and you next 
clearly hear the last line of the first verse... 

I don't think any commercial use would fall under the "Fair Usage" 
guidelines...
