It's Massachusetts. In Massachusetts, regardless of federal law, an age discrimination complaint cannot be won unless a terminated employee was directly replaced by a younger employee. Employers may hire anyone they chose. They just cannot advertise that they are hiring based upon age, race, gender, etc. Because of Federalism, many federal laws do not apply after they have been tested in Massachusetts courts.
At one time an employer could tell an agency to "find some young...." However, somebody got caught so, even in private conversation, they can't say things like that, because it is "advertising." However, the employer is still free to reject an applicant for any reason, perhaps the color of her eyes, or the model of automobile he drives. In recent times, employers have even been emboldened to use such phrases as "too old," "too senior," or "we need young blood," etc.
