In fact, don't just complain.  Add to your complaints demands for an explanation as to why nothing has been done.  Point out that due to the upstream station's lack of compliance, you are rebroadcasting non-EAS programming without consent, which puts your station in jeopardy of a fine, with your only available recourse being placing your station in non-compliance with the rule which says that you must have the means to immediately relay an EAN.  The FCC, at least in my experience, is not very appreciative of stations which deliberately cause other stations to violate the rules.

No action?  Kick it upstairs.  Copy your complaints to the chiefs of the Enforcement Bureau and the Mass Media Bureau, and also copy your state's EAS honchos.  Keep going up the chain until you get some action, and make sure you complain every single time for every single violation.  MAKE NOISE!  The squeaky wheel, etc., etc.,...

And make absolutely sure that, if the FCC comes around, you have plentiful copies of all that correspondence and any replies you receive.  I'm not sure it will shield you from a fine, if you're in non-compliance, but you'll have one heck of a good explanation.
