Aside from the OSHA rules on Lock-out/tag-out and NFPA 110 (as 
incorporated by OSHA rule) regarding arc over protection, I'm not 
sure what remedies are available. If the equipment which was being 
worked upon could be proven to have been neglected through no fault 
of the victim, there's one possible avenue to seek recovery.  HOWEVER 
the station will try to prove that the equipment neglected was the 
responsibility of the victim to maintain.  The key is to prove the 
ownership refused to allow the problems to be corrected.

IOOTH, the equipment was in good condition and the victim simply took 
short cuts by not following good practices and adhering to OSHA 
lock-out /tag-out  (which applies even to one man operations 
technically speaking), there is only the citations issued to the 
owner for not having the necessary materials in place to remain and 
foster compliant operation and maintenance practices.

This is one reason I am so glad that all but two of my main TX's are 
solid state.  But even some of them run >200VDC on the FET's with 
enough current reserves to stop a heart cold.
