Attractive nuisance is the legal thought that when you leave something
unsecured, or accessable easily, that is "attractive" such as a
swimming pool, tower, etc, you are liable for injuries sustained by
someone who swims, climbs, tresspasses, etc.

It depends, if the licensee has turned in the licensee, the property
owner is responsible to maintain lighting on that tower until it is
taken down. I don't think it would be necessary about fixing the fence,
if there is no RF coming from the tower.
If the licensee has not turned in the licensee, then the licensee is
responsible for lighting the tower and making sure the fence is in good
shape and is locked, even if no RF is coming from it, and the station is
dark.
