47 CFR §11.45 No person may transmit or cause to transmit the EAS codes or Attention Signal, or a recording or simulation thereof, in any circumstance other than in an actual National, State or Local Area emergency or authorized test of the EAS. Broadcast station licensees should also refer to § 73.1217 of this chapter.

It is clearly a simulation, for which a licensee may be held responsible.

I have been hearing a lot of "simulations" in commercials, designed obviously, to get ones attention:

(1) Default cell-phone ring-tones
(2) SOS in Morse code, also QRRR
(3) Fire and/or police vehicle sirens
(4) Air raid warning sirens
(5) Now EAS duck farts

When I was working within the broadcast industry, there were no ring-tones or duck farts. However, even the "secret codes" used by CBS to synchronize their stations were not allowed on-the-air! Now, the FCC does not seem to care. I suggest that a lawsuit, bring this to the attention of the courts may be in order.
