[BC] Court rejects RIAA's 'making available' piracy argument

The only difference between the disks as far as the physical disk is
- the RIAA "fee" for audio recordable media. Probably somewhere in
the Copyright Act's latest revisions. Someone mentioned they thought
there was a "flag" set on a "music" CD to identify it to CD
Recorders... which presumably won't record to a data CD; at least
ones manufactured after the rules went into effect. However, a CD-R
drive for a computer couldn't care less; Nero says "burn, baby,
burn!"; so it does.
