Being cautious is a concern. However, if I have a criticism and offer an 
opinion, I'm going to voice it. The first amendment is still in force. The 
problem comes if I offer a statement that can not be proven or is offered 
in what one might consider a malicious manner. Recently Consumer Reports 
won a case where Sharper Image had sued claiming that a critical CR report 
on their Ionic Breeze air purifier was false and damaged their business. 
The court ruled that Consumer Reports was expressing an opinion.

That's a double-edged sword. Is all OK if everyone is talking nice about a 
product, but when someone says something less than complimentary, then they 
get sued?  And lawyers, I got 'em, too.
