So far, the FCC has avoided editorial decisions made in news broadcasts
(including news-lite morning shows).  After the Hawaii false alert, there 
were many news shows that included snippets of EAS/EBS tones in news 
editorial content.

The EAS/EBS tone enforcement has been concentrated on advertisements,
entertainment, reality and other non-news shows.

Of course, history doesn't establish precedent.  But the FCC seem to be 
exercising enforcement discretion to avoid court cases about news 
editorial judgement and 1st Amendment issues.
