Thanks Ira - that is helpful. Live code tests are supposed to be accompanied by adequate public outreach "notifying the public that there will be a test that uses a live code, and, to the extent technically feasible, to inform the public in the test message that the event is only a test (that is, that there is no real emergency)."
The latter was arguable done (by noting test status in the CAP instruction/description text). Did they notify the public directly (e.g. via PSAs) that there would be a live code test?
One other nit - Vermont's description of the scope of Blue Alerts. From the VBA link you helpfully provided, it would seem that Vermont's definition of what is covered under a Blue Alert may go considerably beyond (and potentially be in conflict with) the FCC's definition of who is covered by a Blue Alert .... i.e. by also including "members of the Judicial Branch such as judges and prosecutors, members of Corrections and of Probation and Parole. This will include all members in the law enforcement community from federal, state and local governments." That's a quite broader than the FCC's and DOJ's scope for Blue Alerts over EAS.
