Yes, that's the direction EEW has pushed us in California. We're using ATSC 1 datacast over PBS stations and CAP for very-low-latency transmission. Now we're engaging with broadcasters and others on how best to present the information to the audience... but as you suggest we keep a clear demark between the signaling and the presentation.
And BTW, we're wide open on how geospatially detained alerts should be presented over broadcast radio. A bit of conversation with RDS and RadioDNS folks, but AM remains a challenge.
(Then again, not sure how many AM listeners want to hear anything from the government in any event.)

We are at a point where EAS-II should start being discussed. With ASTC 3.0 containing a field for emergency alerting and advances in data transmission capabilities on both FM and AM, the need for in-band signalling to simply relay messages is no longer needed---except where public notification is desired.
Where that to occur, broadcast would then become an instantaneous attraction for local/state message dissemination.
It's no secret that the PD and GM being part of the loop for relaying messages is hamstringing EAS today. Get them out of picture and we'd have a largely functional EAS system....as opposed to dis-functional.
