I tend to agree that this may be a configuration that doesn't require
additional FCC approval for non-national event codes (i.e. all these codes
allow for transmission anyway up to 15 minutes). 

However, I'm more cautious about national event codes though both NPT and
EAN).  There is a black and white rule on "immediacy" here.  OK, not quite
black and white ... perhaps dark-gray to light-gray...  Would a 2-second,
1-second or less delay be not "immediate" enough?  A rule clarification, as
you suggest, might be desirable in these cases, but hopefully would not
result in a major proceeding.  Again, what is "immediately" upon receipt?
Are a few moments to buffer and now to double check a CAP source allowable?
How many "moments"?

Devices are only required to poll IPAWS for CAP, so we can start there.
I'll be inflammatory here and say I'm a bit less concerned with state CAP
sources as some system, frankly, have been downright undisclosive to some
vendors and preferential to others.  IPAWS is the "universal" CAP bottom
line, and a required monitoring source in Part 11.

Oh, you had to inject that didn't you.  FM radio, AM radio, amateur radio
when all else fails ...  But aside from truly next-gen solutions, it's at
least worth discussing whether the FSK protocol can be enhanced/replaced
with something more efficient, transmitting more data can be transmitted
in-band, with better (or any!) security.  We proposed the TDX protocol, but
that is encountering the expected "not invented here" automated response.
Can we tear something from a MIL-STD / STANAG to chew on as a straw man?
