FEMA doesn't rule on anything - perhaps informally give input. But a waiver
request is entirely within the FCC's hands.
Could the FCC not rule at all? Certainly a possibility - those guys have a
lot on their plate right now (while the FCC gets a lot of static on this and
other forums, folks should remember that the core FCC team is a relative
handful of people handling EAS, WEA, and a host of other public
safety/national security issues).
Could they simply reject the waiver request? Also, very possible. Firstly,
a manufacturer made the petition, not an FCC licensee. So there is the
question of standing (i.e. G-R many not have the standing to make such
request). Secondly, I think the waiver was for an entire subclass of EAS
participant. That's a LOT harder to do than a waiver for a single station,
for a specific reason. I believe the FCC has rejected such a "blanket
waiver" request before.
Could they accept the waiver request? Maybe ... we'll just have to wait and
see.
Could it take a long time, in any event? Quite possibly. Not enough hours
in the day (I've gotten calls from the FCC during quite extended hours, so
I'm firmly believing they're almost constantly busy as heck) ...
