I don't disagree with your assertion ....
However ...
My experience with FCC indicates they get their "testiest" when enforcing rules that have their basis in interagency agreement.
(ie, those that are put in place to support FAA, FEMA/DHS, etc ...)
With that being said - I'll stick with the earlier statement that suggests these agencies try talking out of a unified "mouth" when it's an interagency issue.
(if one doesn't "back room" pressure from FEMA/DHS would play into an FCC levied forfeiture regarding EAS, then I would also like to sell that entity several thousand acres of Nebraska swampland as well)

The last I checked we are beholden to the FCC and only those other agencies (FAA, EPA for instance) as may be directed in the FCC regulations. The only place where FEMA is mentioned in part 11 is 11.2(b)(g) Definitions and 11.61(d)(3) National Tests.
