[EAS] : Fallout Over False Alert Continues

The last I checked we are beholden to the FCC and only those other agencies (FAA, EPA for instance) as may be directed in the FCC regulations. The only place where FEMA is mentioned in part 11 is 11.2(b)(g) Definitions and 11.61(d)(3) National Tests.
No where do I see the FCC deferring to FEMA regulations for EAS as they do, for example, with the FAA for tower painting and marking.

FEMA may recommend action, but if it is contradictory to the section 47 Code of Federal Regulations, I'm siding with the guys who inspect, cite and fine based on the regs that govern broadcasters.
