[EAS] [EAS-WA] Movie trailer potential violation

I was wondering about that- saw it air last night and said to my partner "That's not right"... can't believe they are using those three 'zap'  tones!  ~rb

 You would think the producers of that spot would be well aware of this problem by now. So, if they created simulated EAS tones that 'sounded' authentic, but did not contain any data (or would even decode for that matter), would they still be illegal?
