As a "non-broadcast" use, I don't think the FCC would object to a translator being used for return telemetry, for example. Nor would I foresee issues with using the SCA for a radio reading service.  A semi-broadcast service, such as foreign language programming in a large metro--where there was an on-air competitor, might be troublesome just for "political" reasons.

This is when you pay the guy in DC to walk into the Commission and ask "what if?"
