What happened was Adarand Constructors, Inc. v. Peña - 515
U.S. 200 (1995).

Which is why the Commission --in the same diversity
proceeding that created that asinine "non-discrimination"
notice for non-existent written ad sales contracts--created
a preference for "small business entities."  A small
business entity, as defined by the SBA--is a business with
gross sales under a certain size. Hence there is no
unconstitutional preference by race, ethnicity or gender.
