The rules state what lights must be steady and what must be flashing. Getting a FAA Rule change is more difficult than anything else in the government. I once tried to get a rule-change to allow strobes on aircraft (they were brand new at the time). It took 20 years before they were allowed and I lost my marketing oportunity to Whelen.

However, if steady-burning lights are the primary hazard to birds,
suppose we simply connect the side markers to the same flasher that's
in series with the beacons? (With FAA permission, of course.) This
would retain much of the visibility for pilots, while eliminating the
so-called bird problem.
