Military input was the killer, most likely - NTIA handles their 
allocations.  All those Tomahawk missiles might miss if Lightsquared got 
a go-ahead.....

Since the idea was to take a page from Satellite Radio, and use the same 
transceivers for both satellite and terrestrial links, that's most 
likely put finis to the project - at least until Lightsquared and/or 
someone else finds a different band to use.  How about X-band?  10 GHz.  
Or maybe get above 30 GHz, in unregulated territory...
