[BC] Appeals Court hears WCAL radio trust case

In this case, as with others of the same class character (excluding WQXR
as it was a commerical station), these eletistis think they can manage
from outside the organization. While the socialists of the spectrum might
side with their arguement, this is a VERY slippery slope the state could
fall into should the station/MPR loose the appeal. I can see virtually
every special interest donor group going after that intitution should they
terminate or "sell" a targeted program which used "general donation
dollars" to create or sustain it's existance.
Can you imagine what would happen if a university shut down or changed the
mission of a research lab or a church endded a mission program becuase
they cost too much to operate? Both of which were supported by so-called
"general donation dollars".
Also, since the charitable trust aspect is being invoked, that usually
signals a federal angle as trusts are generally federally regulated as
part of the banking system. But these folks are barking up the wrong tree
if they think a federal judge will grant them relief should the state
court deny their motion. There is PLENTY of precedent...in favor of the
station/licensee.
The really sad thing here is St. Olaf is a highly respected college up
there. Their annual Christmas concert is simply jaw dropping. I'm sure
the college's board saw the sale as a really last resort.
