There was a similar problem in network television many years ago
at NBC.  NBC would insert a small white flashing square in the
upper right hand corner of the screen to alert the affiliates of
an upcoming commercial break.  That was done away with when a
question was raised as to whether the flashing white square was
legal under FCC rules at the time.  I believe the issue was whether
the signal was a transmission on a broadcast channel that was not
intended for the public.
