Theoretically, you are correct, but doing as you
suggest will probably make nothing happen. The
FCC won't admit it, but there seems to be an
unknown cost vs. fine ratio. Unless it is met,
serious efforts to catch a rules violator are
hard to find. Secondly, for some, there may be
a downside risk if their own operations are
imperfect.
What works best is a rapport with someone in the
EB who can make things happen and enough info
to virtually assure a solid, collectible violation.
A complaint by the public will generate an
inspection the next time they are in the area
and that probably will not be on a Friday night
during football season. Regardless how well
documented the formal complaint, they won't write
a NAV until documented by a field engineer from the
District Office, which IMHO, is as it should be.
