When it finally gets to the Federal Court system I believe you are 
correct, but there is all the time spent on hearings within the
Commish before that happens. Both the EB lawyers and the ALJ's 
would be overloaded very quickly if they started enforcing Part 15
with the utilities IMHO, because I doubt the utilities would be
quite so passive as most broadcasters. Secondly, consider the rate
politics.
