With all the lawyers on the FCC staff these days you would think they
could enforce the unintentional radiator standards in Part 15. But, alas,
they have lawyers, not litigators, or so it would seem. IMHO the FCC is
not prepared to fight tough battles with the utilities who do have the
funding to litigate enforcement of Part 15. Thus, if the FCC did place
strict enforcement on the agenda, unless they put the fines up there on
a par with wardrobe "malfunctions" they would never collect enough to
fund the enforcement project, let alone create cash flow for the
Treasury. IMHO, even if they did begin enforcement now, the noise
floor probably would be unaffected. Depending on the real noise
resistance of IBOC, this may or may not be an argument for using it.
