In most cities it is a violation of the law to allow an animal to
defecate on public property, or another person's private property,
without cleaning up said defecation. He has no legal right to allow his
dog to do his business on that right-of-way.
However you look at it, the person allowing his dog to use property
which is not his, is wrong. Period.
