In this case, the rules don't matter.  What matters is that a powerful
politician uses his influence to circumvent the law.  This guy NEVER even
bothered to file for an LPFM, and now he's get an STA allowing him to
continue operating.  What is wrong with his picture?  Who wants to call
ASCAP, BMI and SESAC and tell them about this guy?
