No frequency-agile transmitter will ever be type accepted by the FCC for use under part 73 so that is not an issue. Transmitters that operate under a STA are required only to not produce "harmful" interference. <disclaimer> I am not a lawyer. For legal advice, contact one. </disclaimer> The FCC has always allowed a broadcaster to, under special (or emergency) circumstances to deviate from any rule to the extent necessary to meet those circumstances. This is the reason why one can bypass portions of a transmitter to keep it on the air in an emergency, etc. Some have even brought their 10-watt FM exciters downtown and hooked them to a TV Antenna to stay on-the air when a transmitter site got destroyed by ice falling from a tower. Anything goes (except harmful interference) under those circumstances. You are expected to obtain "telegraphic authority," which now means "email authority" as soon as possible. You can do this AFTER you have actually taken the steps necessary to sta!
 y on-th
e-air. This is because, as a licensed broadcaster, you have a commitment to meet the needs of your communities "convenience and necessity."
