 Unless my senility is worse than I remember, it was Congress who ordered
 the FCC to be this way.

 Yes, but you knew that going in !

 Since this whole auction thing reared its very ugly head, I've given up any
 motivation for anything in this regard, because as you say, the deck is
 clearly stacked such that whoever gives Congress the most money
 in the very short term wins !
 
 Why would anyone less than Clear Channel even try
 to have a channel alloted ?
