When the current administration came to power, they declared that "citizen by birth" doesn't exist unless BOTH the parents were, not just in the country legally, but had obtained permanent residency status! Basically GB declared that the Constitution doesn't apply to anybody who has not reached permanent residency status. That's one of the reasons we now have an "illegal alien" issue where we did not have such a grave issue in the past There are many two and three generation tax-paying, and voting Americans that were suddenly disenfranchised by the George Bush rules. They can't even be deported because their country-of-origin is the United States! Therefore, they are imprisoned at the Federal Detention Center at (Fort) Devens.
These new rulings came about because many aliens who could afford it would enter the country on a visitor's visa during late term pregnancy. The child would be born here, hense a citizen. Then a US Lawyer would be given power of attourney over the minor child and petition the parents for permanent residency status. This was all legal. Since Bush wanted to prevent this, the borders were closed to all the "unwanted" visttors from hispanic countries. This meant that parents of a soon-to-be-born-here citizen needed to enter illegally. To counteract this, Bush declared that children born under these circumstances are not protected by the Constitution. When I refer to Bush, I refer to the "Homeland Security" cabinet setup that Bush created. They took over the INS and, it seems, the Justice Department as well.
